JESSICA’S LAW: WHEN FEAR PERVERTS JUSTICE AND PUBLIC SAFETY.

When Jessica’s Law passed a few years ago, it was clear that it was an emotionally-based piece of legislation, not a practical one, and that it would eventually be challenged in court. That day has arrived and the decision is due Monday from the California Supreme Court.

Of all those who commit crimes, sex offenders are the most reviled, even inside prison. Yet the designation covers a wide range of offenses, some serious, some comparatively minor. Whatever the offense, when the offenders are paroled, like all of us, they must have a place to live. Throughout the state, Jessica’s Law has made living anywhere but the street all but impossible as this late December SF Weekly article describes.

In short, the unrealistic, ill-thought-out law prevents the sex offenders from finding stable living arrangements and keeps exactly no one safer. Let us hope that the CA Supremes strike it down.

“We are actually walking time bombs out here because we are suffering from sleep deprivation,” said a paroled sex offender who wished to remain anonymous.

Some of them choose to be homeless, but the 45 sex offenders released from prison to San Francisco after Jessica’s Law took effect, are forced to serve their three-year parole living on the streets.

This law needs to go.


CUTTING CULTURE

Monday the City Council’s budget committee is due to discuss ways to address the fact that the city is facing a shortfall of $208 million. One of the cuts that has a great many people extremely upset is the elimination of LA’s Cultural Affairs Departments, which gives grants for art programs for kids, community concerts and a great many other programs that are of enormous value to the health and well being of the city’s neighborhoods and communities.

Among those protesting the cuts at Monday’s meeting will be LA’s iconic author/poet Luis Rodriguez whose cultural center/book store, Tia Chucha is renown for its rich programs


IS THERE AN ECOLOGICAL UNCONSCIOUS?

Sunday’s New York Times Magazine has a fascinating article about scientists that are looking at the psychological interplay between human beings and their environment. Among the ideas they are exploring: the emotional costs of ecological decline. It’s more than worth your time.

By the way, a slightly different but related thought: There has been much talk about the damage to the psyche caused by solitary confinement. But is it the lack of human contact alone that drives people crazy in solitary? Or is it, at least in part, the separation from from any sight of the sun, the trees, the sky?

Adolfo Guzman Lopez has the story of a special assembly with Los Lobos guitarist Louie Perez at the Frida Kahlo High School in LA. Frida Kahlo is Big Picture charter school, a group that has a great record got getting and keeping kids in school, helping them discover and develop their talents, thus allowing them excel.     The Los Angeles economy mirrors the rest of the country.

    People who dial in on local fiscal politics are either bored to death or have some kind of stake in the outcome politically. It might be the single most boring form of journalism there is, next to the crime blotter. A city with with a ghetto about the size of New Hampshire, and there’s crime. You don’t say? Again, same thing. Bored to death, or have some kind of political stake in it all.

  • LA’s economy does NOT mirror the rest of the country. There are a few other places in as bad a shape as LA, but most municipalities are not in near as bad of shape as LA. Hard to believe, but there ARE municipalities that are NOT running at deficits.

    Are you aware Rob Thomas is an expert all things concerning the L.A. area? R.T. is an even an expert on the L.A. Metro Rail system.

    Although I do seem to remember another economic genuis (SNS) telling us California is the richest state in the country.

    I am an attorney who works mostly in the area of parole and I love your coverage of all the recent changes. I agree with you about the failings of Jessica’s Law and I was very disappointed to read the CA Supreme Court Opinion today.

    Anyway, thanks for such interesting pieces of news each week! I always look forward to reading your blog.

  • After extensive investigation (I asked my friend Refuglio) I learned that the term “coconut” is a reference for a person who’s brown on the outside with a white interior. So now you know, Rob. Surely someone so well versed in all things ethnic would have known that. Come on rob, fess up?

  • Most of our laws regarding sex offenders are unnecessarily harsh. Long after prison sentences are completed, we still legally punish people convicted of sex crimes. I’ve heard stories of homeless sex offenders dying in the middle of winter because local laws prevented them from staying at certain shelters that were close to schools.

    I was told it was a reference to a brown head inside a white pillow case or sewing a brown face onto a white soccer ball. It’s become part of modern mexican culture, sort of resorting back to the mayan days.

    The decapitated bodies of two men were found Saturday in the sand dunes east of Juárez. Chihuahua state police said the men had their hands and feet bound with tape and had been shot. Their severed heads were inside a pillow case.

  • Yeah, that’s it–they molest kids because they’re sleep deprived. Give ’em 40 winks, problem solved. How did we miss this, all these years?

    Whenever I am upset I call my best friend for validation. Just having someone listen allows me to vent and get some of those toxic angry feelings out of my body instead of me stuffing them back down with food.

    I don’t know what you do when you’re feeling frustrated, bored or upset, but a lot of women eat. Sure, a few cookies now and then aren’t going to kill you, but there are so many better ways to take care of yourself Kim!

    We are always willing to justify eating crap by saying, “I had a rough day. I deserve this.” Deserve what? Heart disease? Cellulite? Diabetes? Come on! Would you reward your loved ones this way? I bet not. What do I do to make myself feel better?

  • Yeh, Gava Joe, regarding the coconut thing. I didn’t know what it meant. This Latino guy was just really insulting Mexicans and another Latino guy called him a coconut and a disgrace. Wow. The guy was crushed. He was all, “I love my country”, and the other Latino guy was like, “whatever, coconut”. Then the guy who got called a coconut said, “you’re a cholo” and ran off crying. So, I just wanted to know what that was all about.

  • I have no sympathy for child molesters of any type. Rape and true child molestation are vastly under reported crimes so if any of these truly evil idiots die, oh well. Look up just about any serious study and that’s what you’ll find and there are plenty out there.

    As for people who got tagged because at 18 they were doing it with their 17 year old girlfriend, they shouldn’t be on any list long as it was consensual. A common sense approach is needed to distinguish between the truly sick and demented molester and others.

    But if you read what the ACLU and the anti-Jessica’s Law group put out even the most egregious of these people can get all better with a stable life environment…b.s.
