It was the nation’s biggest terrorism finance case ever—but after fifteen years and millions of dollars spent to shut down and prosecute the Holy Land Foundation, the criminal case ended in a mistrial two weeks ago in law-and-order Dallas. [Find that story here] .

The charity’s guilt was presented as a sure thing back in December of 2001 when George Bush announced at a Rose Garden news conference that the Holy Land Foundation was raising money in the U.S. that “pays for murder abroad,” and that the Treasury Department was freezing Holy Land’s assets and seizing its offices.
Now it appears that the then-secret evidence for closing the foundation was flimsy at best, and based almost primarily on the word of Israeli agents who had a not-so-objective interest in seeing Holy Land shut down.
At present, although defendants and attorneys are bound by a gag order, jurors and others others involved are not, reports the LA Times’ Greg Krikorian. And they are talking up a storm:
“If the government can shut them down and then not convince a jury the group is guilty of any wrongdoing, then there is something wrong with the process,” Georgetown University law professor David Cole said.
George Washington University law professor Jonathan Turley said the criminal trial derailed the government’s long-publicized assertions about Holy Land.
“From the beginning, the allegations were highly suspect and only got worse,” said Turley, who has handled a number of national security cases.Indeed, Turley said, if the government had begun with the troubled criminal case, it might never have succeeded in closing down the foundation administratively because its disputed evidence would have come to light years ago.
Such criticisms echoed those of Holy Land lawyers who had long complained that the charity was railroaded out of existence without due process of law and based on secret evidence.
“Before a person’s domestic pet can be taken away for being vicious, they are at least entitled to a hearing. So what happened to Holy Land wouldn’t happen to a dog,” John Boyd, one of Holy Land’s lawyers, said in an interview more than a year before the court imposed a continuing gag order.

Celeste, think on two things. A mistrial does not mean that the defendents were guilty, or not guilty. Secondly, money is fungible. If you give a dollar here for “charitable purposes” does that not release a dollar somewhere else for some other purpose if in fact the charity was a front?
Just my 1 and 3/4 cents (inflation you know).
Also, the government would be reluctant to use highly classified evidence which might blow future surveillance. Isn’t it amazing that liberals will whoop and howl when terrorist related defendants are cleared but insist to their dying days that patriots are guilty of crimes despite findings of innocence? But, it’s nice to know that you are concerened about excessive investigation costs and will demand that the Democrats drop their extensive, expensive, and time-consuming investigations into the White House. What a stretch to relate counterterrorism today to “Order in Quarters issued by General George Washington”–EIGHT MONTHS BEFORE THE DECLARATION OF INDEPENDENCE WAS SIGNED.
This also shows a terrible understanding of the true George Washington, who quickly had hanged anyone who was a deserter or traitor.
Well a few facts:
On most charges – including the most serious ones – the defendants were found NOT GUILTY.
If you believe that money is fungible and any contributions to organizations that end up with so-called terrorist groups show complicity then the DOJ should indict the State Dept since AID funds went to some of the same groups that received funds from the Holy Land Foundation!

You’re right, there are no terrorist threats anywhere — that honor belongs solely to Bush/Cheney. (Not that this has anything to do with whether or not Holy Land is guilty of supporting Hamas/ terror organizations, or not.
Actually, on that one, I take a more middle stand and say that it’s hard to support charities in Palestinian territories which don’t have some overlap with groups also dealing with Hamas, so the mere impression of contact with them does not prove guilt. As long as the monies go strictly to humanitarian, civilian causes. Whatever the merits of this case or lack thereof, the government did cast suspicion on its own wide net, which could in fact make it easier in future for genuinely terrorist-linked charities to operate and claim that our government is just judging them by casual association.)
