Dear LAPD: About those incidents in MacArthur Park. Look. We know that rushing to judgment is a bad thing. However, we do believe even in these early days, there are some lessons to be learned.
Here are six to get you started:
1. If you feel you must start whacking people with your respective batons, you might want to avoid whacking reporters with live mics and very large TV cameras—particularly in front of other reporters with live mics and very large…etc.

2. It’s entirely unacceptable to fire rubber bullets into a crowd of people unless there’s a true emergency. This wasn’t an emergency. Those bottle-throwing guys you tangled with earlier where nowhere in the vicinity by then. And the videos make clear that the rubber bullets were being fired indiscriminately in order to herd the crowd, which included mothers with their kids. Not okay. A high up member of LAPD command staff once remarked to me that he thought the department had an overdeveloped concern, almost a fetish really, for officer safety, and that it sometimes kicked in at moments like these—and not in a good way
2. The press have a job to do and, on Monday in Mac Arthur park, they had every legal right to be doing it. You were the ones out of line. We thought this issue was cleared up conclusively seven years ago after LAPD officers assaulted several reporters outside the Democratic National Convention. In a settlement with the ACLU (the assaulted reporters acting as plaintiffs) the department agreed that, after an order of dispersal (as happened on Monday), the press still had a right to be present. Why didn’t every officer in riot gear know that? These weren’t patrol officers, these are cops from SOB—Special Operations Bureau. One would think that being up to speed on reporter/police/ crowd protocols might be a relevant part of their job description.
Furthermore, the reporters reporters you pushed and hit had very visible press badges —LAPD issued press passes, in fact—and/or large expensive TV cameras.
3. We don’t need nine months to investigate this. My journalism students have to turn in highly researched 20 page papers, plus weekly assignments, all in a ten week quarter. And they have three or four other teachers making equivalent demands on their time. Surely the professionals investigating these incidents can get us some kind of result by the end of June.
4. It’s good that Chief Bratton got out there fast and said all the right things. But, the truth is, somebody else besides the LAPD must run an investigation. The mayor has asked the Inspector General, Andre Birotte, and the Police Commission to investigate along with the police. No disrespect to Andre intended, but that’s not good enough. The IG’s job is, theoretically, to provide the department with some civilian oversight and Birotte is an ethical, smart, savvy guy. Sadly, however, he can investigate ‘till the cows come home but, until he has the power to institute disciplinary actions, his investigations don’t mean a damn thing.
5. Frankly, District Attorney Steve Cooley should be the one to launch his own investigation. Will somebody ask him please?
6. It’s important to remember, there were thousands of LAPD officers deployed on the streets on May 1st. And, as with the marchers, only a few behaved questionably. The majority—of both groups—were a credit to the city.
Responses by point:
1. I disagree with the phrasing of the lesson, which infers a bias on a conclusion for which additional information my be available.
2. The press does not have a legal right to disobey police orders. A settlement outside of a full trial with the ACLU on a different case was likely a way to cut defense costs and does not give legal immunity on all future situations.
3. Your journalism students are taking previous completed and published studies to do their studies–something much easier. Plus, that is their full-time job. Also, if they do a bad job without being sure, it only hurts their grades rather than destroys lives and reputations. The comparison is not valid.
4. An initial internal investigation is sufficient until and if it reveals something that requires an expanded review. Does the Journalism Department at USC let the Business School make initial determinations about the performance of that department? It’s a good thing that they don’t.
5. Frank, please launch your own investigation. There. Consider it done.
6. Then, this isn’t necessarily a failure of the LAPD but something that needs to be addressed with a few specific individuals.
Celeste, you give the press more room and special treatment than they deserve. Having a press badge doesn’t make you more of a citizen than others or allow special rights. The City of Los Angeles just doesn’t throw open their books when I appear on their steps saying that I’m an accountant and I want answers.

We can assume that Woody hasn’t actually followed any of the links or read anything about this particular event, but instead reflexively supports police action, no matter how violent or inappropriate. Woody believes that reporters should be beaten if they are standing in an unruly crowd. Thankfully, no one with authority shares his draconian views.
In the words of Chief Bratton, “We should never be engaged in attacking anyone in the media.” As to the general behavior of his force, Bratton commented, “Quite frankly, I was disturbed at what I saw,” stating that some officers actions “were inappropriate in terms of use of batons and possible use of nonlethal rounds fired.”

The use of force looks terrible and I will be very surprised if it is determined that anything occurred to justify it. However, for a “high up member of LAPD command staff” to say that the department has an overdeveloped concern, “a fetish,” for officer safety, is unconscionable. I am struck by the fact that today in Sacramento, the Peace Officer Memorial Foundation is honoring the 12 officers killed in the line of duty in 2006. In no other profession does dressing for work equate to putting a target on your back. Being overly aggressive, tunnel vision, failure of good sense may all be involved in the most recent incident; but please do not ever belittle a peace officer’s sense of the need for officer safety.
This is another example of how the police often behave, but most of them are smart enough to do their “police beatings” when they think no one is recording them.

What started out as a simple police beating of civilians and journalists, seems to have turning into something worse — a HATE CRIME.
That’s right, it is obvious to anyone who saw the tapes that the police were all wearing BLACK, and they were shouting, pushing, gassing, shooting and beating BROWN people. Even the journalists were ALL BROWN, many who are secretly GAY, but don’t know it yet.
As the FBI starts it’s lengthy investigation, they will now doubt realize the DARK HIDDEN THOUGHTS that bust forth on May 1 2007 from a place of HATE.
These dangerous thoughts would allow the FBI to triple their punishment, only if Bush would quickly sign the “Federal Hate Crime Billâ€Â.
Proof of HATE would not be necessary, since only the victims perception is required. After all, we are all sure that the victims of this melee felt hated, and that is all that is required is the victims perception under this new law.

Charles, I can understand your anger at my comment. I think what I wrote was a bit more abreviated than it should have been. Certainly we all understand that police officers and sheriffs put themselves in harms way for the rest of us. Family members of officers are never without worry as a result.
All that said, however, after having spent time at the LAPD academy and sat in on officer safety sessions, watched various training videos, and just having made nearly two decades worth of street observation in and around shooting scenes, I’ve come to believe that, in an effort to make sure officers take appropriate precautions, there has, for years, been a trend in training to hammer in the message: “Don’t ever forget, the scumbags are out to get you personally, the gang members are out to get you personally, a lot of people are out to get you personally.”
And that’s an unhelpful, misleading and paranoia-inducing message to repeatedly give our LAPD officers. Crazy, screwed up bad guys (and occasionally women) shoot police. Most gang members, for instance, wouldn’t dream of it—simply for selfish reasons. Every homeboy knows that if a member of thier gang takes a shot at a cop it will bring the wrath of god down on that gang. Sometimes crazy, sociopathic homeboys do it anyway. But the majority do not, would not.
But here’s the thing. I believe this is a fundamental flaw in the training. Of course we want officers to be trained to, on instinct, back up and protect each other and themselves. A force couldn’t possibly function without such training. But we don’t want to induce unnecessary paranoia into our officers’ respective states of mind and, I believe that’s exactly what’s been done on an institutional level—although, no one means to do it.
Officer safety is a worthy and necessary goal—but Officer Safety at All Costs is a different deal….particularly when combined with the bunker mentality that still exists at certain levels of the department.
I can’t be sure, but I think that’s some of what happened on May 1st I think that the cops got some intelligence that the anarchists or troublemakers or whoever they were, were going to be in or near the park. Then there was the incident where some bottles were thrown, but worse, somebody knocked a cop off his motor cycle—and this set everyone off and got the adreneline to pumping.
At that moment, leadership could have stepped in and calmed the waters. Instead, someone gave orders to shut down the rally—but it was not done in a well planned way. So, rather than giving marchers a chance to respond appropriately, officers behaved agressively from the get go—although that agressiveness was not called for, since the agressive guys were elsewhere by that time. So what caused the cops to start whacking and shoving at media and marchers? Something caused an inappropriate, jack-booted, comand and control mentality to kick in within a group of the officers deployed, and things went bad from there.
Training can shift that. Malcolm Gladwell, the author of Blink and The Tipping Point, has a great section about how NYPD officers came to fire 41 shots into an unarmed Amadou Diallo. It wasn’t meanness or racism, but the wrong training. So when they were running on gut instinct, the wrong “gut instincts†kicked in, instead of the wise and right ones.
