Happy Monday, WLA readers.

Specifically, it’s Monday, Oct 26, 2026.

And on this particular Monday, the a panel from the 9th Circuit Court of Appeals said NO to the President and his team, in response to an emergency request in which the U.S. Justice Department and POTUS asked the justices at the 9th Circuit to step in and prevent California election officials from counting around 20,000 ballots cast by Californians who registered to vote, but whose citizenship the Trump administration questions.

The three circuit justices who heard the arguments, were Judge Mark J. Bennett, Judge Eric D. Miller, and Judge Jennifer Sung.

Yet not all three of the panelists agreed with each other regarding the filing by the president.

Once the panel had a 2 to 1 decision, the text of the opinion itself, was written by Judge Sung, who was appointed by President Joe Biden.

Yet, In addition to main opinion, there is an interesting concurrence written by Judge Miller, who was appointed by President Donald Trump in 2019.

Judge Bennett, who was also appointed by President Donald Trump—but a year earlier, in 2018—wrote a dissent that is also worth your time.

Bottom line: Getting to today’s decision appears to be have been complicated.
